TERMS OF SERVICE

These Terms of Service ("Terms") govern your use of the GrowthShower WordPress plugin and associated services ("Service") provided by Qoptervzn Infocom Pvt Ltd ("Company", "we", "us", or "our").

By installing, activating, or using GrowthShower, you ("User", "you", or "your") agree to be bound by these Terms. If you disagree with any part of these Terms, you may not use our Service.

1. SERVICE DESCRIPTION

GrowthShower is a WordPress plugin that:

• Connects to your WooCommerce store via REST API
• Analyzes sales, customer, and product data
• Generates automated daily reports
• Delivers insights via WhatsApp messages
• Provides dashboard access for historical data

The Service operates as Software-as-a-Service (SaaS) with plugin components installed on your WordPress site.

2. ELIGIBILITY AND ACCOUNT REGISTRATION

1. You must be at least 18 years old and legally capable of entering binding contracts.
2. You must own or have authorization to manage the WordPress/WooCommerce site where the plugin is installed.
3. Account registration requires a valid email address and accurate billing information.
4. You are responsible for maintaining the security of your account credentials.

3. SUBSCRIPTION PLANS AND PAYMENT

3.1 Subscription Tiers

• Service is provided on annual subscription basis
• Different plans offer varying features and site limits

3.2 Payment Terms

• Subscriptions are billed annually in advance
• All fees are in Indian Rupees (INR) unless otherwise specified
• Payment due immediately upon subscription or renewal
• Accepted payment methods: Credit/debit cards, UPI, bank transfer

3.3 Refunds

• 14-day money-back guarantee for new subscriptions
• Refunds processed within 7-14 business days
• Partial refunds not available for unused portions of annual plans

3.4 Price Changes

• We may modify pricing with 30 days' written notice
• Price changes apply to subsequent billing cycles only
• You may cancel before price increase takes effect

4. PERMITTED USE AND RESTRICTIONS

4.1 Permitted Use

You may use GrowthShower solely for:

• Analyzing your own WooCommerce store data
• Receiving business insights and reports
• Internal business decision-making purposes

4.2 Prohibited Activities

You may not:

• Use the Service for stores you don't own or operate
• Reverse engineer, decompile, or attempt to extract source code
• Resell, redistribute, or sublicense the Service
• Use the Service to violate any laws or regulations
• Interfere with or disrupt Service operations
• Access data belonging to other users
• Use the Service for fraudulent or malicious purposes

5. DATA PROCESSING AND PRIVACY

• The Service processes your WooCommerce data to generate reports and insights.
• Data processing is governed by our Privacy Policy, incorporated by reference.
• You warrant that you have necessary rights and consents to share customer data with our Service.
• We implement industry-standard security measures but cannot guarantee absolute security.
• You remain the controller of your customer data; we act as processor.

6. INTELLECTUAL PROPERTY

• GrowthShower plugin, algorithms, and related technology remain our exclusive property.
• You retain ownership of your store data and content.
• We grant you a limited, non-exclusive, non-transferable license to use the Service during your subscription term.
• You may not remove or modify any proprietary notices or labels.

7. SERVICE AVAILABILITY AND SUPPORT

• We strive for 99.5% uptime but do not guarantee uninterrupted service.
• Planned maintenance will be announced in advance when possible.
• Support is provided via email at support@growthshower.com.
• Support response times vary by subscription tier.

8. LIMITATION OF LIABILITY

• TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.
• WE ARE NOT LIABLE FOR:
• Indirect, incidental, special, or consequential damages
• Lost profits, data, or business opportunities
• Third-party actions or content
• Service interruptions or data loss
• THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

9. INDEMNIFICATION

You agree to indemnify and hold harmless Company from any claims, damages, or expenses arising from:

• Your use of the Service
• Violation of these Terms
• Infringement of third-party rights
• Your store data or business practices

10. TERMINATION

1. Either party may terminate the subscription with written notice.
2. We may suspend or terminate your account immediately if you:
• Violate these Terms
• Fail to pay fees when due
• Engage in prohibited activities
3. Upon termination:
• Access to the Service ceases immediately
• We may delete your data after 30 days
• You must uninstall the plugin
• No refunds for partial periods

11. FORCE MAJEURE

We are not liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, government actions, internet outages, or third-party service disruptions.

12. GOVERNING LAW AND DISPUTES

1. These Terms are governed by Indian law.
2. Disputes shall be subject to the exclusive jurisdiction of courts in Bhandara, Maharashtra, India.
3. Before litigation, parties agree to attempt good-faith resolution through direct negotiation.

13. MODIFICATIONS TO TERMS

1. We may update these Terms at any time by posting revised terms.
2. Significant changes will be communicated via email or in-app notice.
3. Continued use after changes constitutes acceptance of new terms.
4. If you disagree with changes, you may terminate your subscription.

14. MISCELLANEOUS

• These Terms constitute the entire agreement between parties.
• If any provision is deemed invalid, the remainder remains in effect.
• Failure to enforce any right does not waive that right.
• You may not assign these Terms without our written consent.
